SBA 8(a) Program Suspensions Following Data Calls

The Small Business Administration (SBA) has issued suspension notices to over 1,000 8(a) Business Development Program participants after determining that those firms failed to adequately respond to an SBA data call requesting updated ownership, control, and eligibility information. These actions occurred shortly after the 8(a) Program’s January 19, 2026 audit deadline, following SBA’s review of submissions from approximately 4,300 active 8(a) participants.

Firms that either did not submit the required documentation by the deadline or submitted incomplete information received notices of suspension. These suspensions take immediate effect and temporarily bar affected firms from receiving new 8(a) awards while SBA resolves outstanding eligibility concerns.

Regulatory Impact of Suspension:

Pursuant to 13 C.F.R. § 124.305(b), during the period of suspension:

  • Competitive and non-competitive 8(a) contract awards, including opportunities self-marketed by the firm, will not be made unless the head of the procuring agency (or an authorized representative) determines that award is in the best interest of the Government and SBA concurs with that determination.

  • Previously awarded 8(a) contracts remain in effect, and suspended firms remain obligated to perform existing contracts, including the exercise of options and in-scope modifications, unless otherwise prohibited by statute or regulation.

Affected firms may pursue corrective actions, including submission of an informal response or, where applicable, an appeal to SBA’s Office of Hearings and Appeals (OHA).
